Malaysia passes Anti-Sexual Harassment Bill with very minor amendments, despite widespread criticism

Malaysia’s Dewan Rakyat (Home of Associates) has handed the Anti-Sexual Harassment Bill 2021, regardless of unaddressed concerns of considerable shortcomings in the Invoice.

The Monthly bill was initially tabled for its to start with reading through in December 2021 (Study our former submit: &#8220Malaysia’s Anti-Sexual Harassment Invoice tabled in Parliament&#8221). It was then withdrawn from a next reading through previously in 2022, with the authorities indicating that it would be considerably reviewed pursuing robust responses obtained from many functions. Sad to say, the Invoice which was handed this 7 days only experienced quite insignificant amendments from the very first draft.

Owing to the constrained revisions built from the to start with draft, our summary of the Bill revealed in December 2021 is even now primarily accurate: https://themalaysianlawyer.com/2021/12/15/anti-sexual-harassment-monthly bill/

These are the materials changes in the up to date model of the Monthly bill:

  1. A new Clause 7(3) is integrated, introducing a limitation time period for sexual harassment problems: &#8220A grievance referred to the Tribunal less than this Act is matter to the Limitation Act 1953.&#8221
  2. While the original edition offered that parties at the listening to of a sexual harassment complaint can’t be represented by an advocate and solicitor, this has been revised [at Clause 13(2)] to give that authorized representation will be permitted if &#8220in the belief of the Tribunal, the subject in query requires advanced problems of legislation&#8221. The revisions also deliver that if a person celebration is authorized to represented by an advocate and solicitor, then the other bash will also be so entitled.

With these incredibly confined changes, it seems that the problems raised by a lot of rights organisations who had hoped for &#8220a meticulous assessment of the Invoice&#8221 have been still left unheard. Time will tell whether the new long-awaited legislation will be complete more than enough to secure the rights and wellbeing of sexual harassment victims.
